Description

The Naval Air Systems Command (NAVAIR) intends to issue a sole source Delivery Order to BAE Systems Information and Electronic Systems Integration, Nashua, NH, to convert 1,920 domestic Rotary Wing (PN 8444450-1) and Fixed Wing (PN 8508671-1) APKWS WGU-59/B Guidance sections into Foreign Military Sales (FMS) Rotary Wing (PN 8497980-1) WGU-59/B guidance sections, to deliver supporting documentation detailing the conversion process, and to participate in a verification event under Basic Ordering Agreement (BOA) N00019-21-G-0003. This contract is being pursued on a sole source basis under the statutory authority of 10 U.S.C. § 3204(a)(1) (formerly 10 U.S.C. 2304 (c)(1)[1]) as implemented by Federal Acquisition Regulation (FAR) Subpart 6.302-1, only one responsible source and no other services will satisfy agency requirements. BAE Systems is the sole designer, developer, and manufacturer of APKWS, and as such, is the only known source available with the requisite technical knowledge, experience, and tooling to produce the requirements described herein to satisfy the Government’s requirement. Unless otherwise stated herein, no formal request for proposal or additional written information is currently available. Request for same will be disregarded. This notice is not a request for competitive proposals. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information provided herein is subject to change and in no way binds the Government to solicit for or award a contract. This effort requires access to “Military Critical Technical Data” requiring a DD Form 2345, and the data associated with the Advanced Precision Kill Weapon System II (APKWS) which is export controlled and is not available to foreign sources or representatives.
